These Terms & Conditions govern your use of playwithdiamonds.com and purchases from Play With Diamonds. Please read them before creating an account, requesting a quotation or confirming an order.
We manufacture and supply wholesale gold jewelry. Our website is a catalog: you create an account, add your selection to the quotation basket and submit a request. We prepare your price quotation manually and email it to you. Submitting a quotation request does not place a paid order or charge your payment account.
By using the website, creating an account or confirming a purchase, you agree to the terms applicable to that activity. Your accepted written quotation and order confirmation also form part of the agreement for your purchase.
1. Eligibility and Authority
You may use our services and purchase products only if you can enter into a binding contract and comply with these terms and applicable laws. If you act for a company or another organization, you must have authority to act on its behalf.
The website is not intended for children under 13, who must not use it. Older children should be supervised by a parent or legal guardian and may not independently enter into a purchase agreement unless legally able to do so. Parents and legal guardians are responsible for determining whether the content and services are appropriate.
By registering or confirming an order, you represent that you have the right, power and authority to fulfill your obligations and that no legal disability or contractual restriction prevents you from doing so.
2. Product Information and Availability
We aim to describe our products accurately, but website descriptions, specifications, images and other content may contain errors or become outdated. Confirm the product codes, materials, stone specifications, dimensions, quantities and variations in your written quotation before accepting it.
Colors may appear differently on different screens and devices. Product photographs do not replace the specifications agreed for your order.
Catalog listings and website stock indicators do not, by themselves, guarantee immediate availability or an agreed delivery date. We confirm availability and any production requirements when reviewing your selection. We may add, change or discontinue products, categories or services.
3. Quotation Requests and Order Confirmation
To request a catalog quotation, create an account, select the products and quantities you require, and submit your quotation basket. For a new design, use our custom gold jewelry inquiry form.
An automated acknowledgment confirms receipt of your request only. It does not confirm a product price, availability, an accepted order or a production booking. We review the details and send a quotation to your email address.
Check the quotation carefully and ask us to correct any errors before accepting it. An order proceeds when we have confirmed acceptance in writing and the payment and approval requirements stated for that order have been met. Each new order is reviewed separately.
We may decline a request or cancel an order where it is reasonable to do so, including where products cannot be supplied. If we cancel an order, payments made for the canceled products will be refunded in full. This does not affect rights that cannot be excluded under applicable law.
4. Quotations and Prices
Product prices are supplied by individual quotation and are not displayed as public catalog prices. Your quotation sets out the applicable currency, product specifications, quantities and charges. Our current minimum catalog order is US$999; project-specific requirements are confirmed in writing.
Gold and other material costs can change. Check any quotation validity period and confirm the price before proceeding. Changes to the design, materials, stones, quantities or delivery arrangements may require a revised quotation.
Although we take care when preparing quotations, pricing errors can occur. If we discover an error, we will inform you and explain the corrected price before proceeding. If you do not accept the correction, you may cancel the affected order and receive a full refund of amounts paid for it. We will not silently substitute a different price.
5. Payment
Payment is arranged after the quotation has been reviewed and the order requirements agreed. The quotation or invoice confirms the available payment methods, payment schedule and any applicable charges. Depending on the arrangement, methods may include bank transfer, PayPal, credit card, debit card or cash.
Made-to-order production normally requires a 50% deposit, with the balance payable before dispatch, unless a different schedule is agreed in writing. Confirmed stock orders and other projects follow the payment requirements stated on their quotation or invoice. Products must be paid for as agreed before shipment.
Adding products to the quotation basket or sending a request does not automatically charge a card or PayPal account. We provide payment confirmation or a receipt using the contact details supplied for the order.
Payment providers process transactions under their own terms and privacy notices. We use reasonable safeguards, but no payment system or transmission method can be guaranteed completely secure. Do not send full card details, security codes or account passwords through our inquiry forms or by email.
6. Production, Delivery and Import Charges
Timing is confirmed for each order. As a general guide, confirmed stock orders require 1–3 business days to process after payment and receipt of the required details. Made-to-order production generally takes 6–8 weeks from receipt of the deposit and completion of the required approvals. Design development, sampling and changes may add time. Courier transit and customs clearance are separate.
Shipping charges, the courier service and any special delivery requirements are agreed with your quotation. Import duties, taxes and clearance charges are the buyer’s responsibility unless the written quotation states otherwise. Supply complete and accurate delivery and contact details.
Read our production and shipping information for processing, courier and delivery details.
7. Risk of Loss and Shipping Insurance
Products are supplied under a shipment contract. Unless a different arrangement is agreed in writing or applicable law requires otherwise, risk of loss and title pass to you when we hand the products to the carrier.
Shipments through our FedEx service include insurance cover up to US$1,000 at no additional charge. This is not an automatic promise of insurance for the full value of every order. For higher-value parcels, arrange appropriate additional cover with us before dispatch. Additional cover, including Malca-Amit services where available, is quoted separately.
Insurance for DHL, UPS or another service must be confirmed individually. The insured value, applicable conditions and claims procedure should be confirmed for your shipment. Inspect the parcel promptly on receipt, report problems as soon as possible, and keep the packaging, shipping labels and relevant photographs. We do not cover subsequent loss or destruction after delivery, subject to applicable rights.
8. Returns, Refunds and Custom Orders
Contact us within 30 days of delivery to request a return. The conditions, inspection requirements, return shipping arrangements and refund processing are explained in our returns and refunds policy.
Custom design items are non-refundable unless damaged or defective, subject to applicable rights. Check the design and specifications before approving production. If an item is defective or differs from the approved specification, contact us with the invoice reference, product code, a description and photographs.
You can submit a return request using a website order number or a manual invoice reference. Submitting the form does not automatically approve a return or refund. Nothing in this section limits rights that cannot be excluded under applicable law.
9. Your Account and Communications
You are responsible for keeping your password and account information confidential and for activity under your account. Provide accurate details, sign out when using a shared device, and notify us promptly of unauthorized use or another suspected security breach. Do not use another person’s account without authorization.
To the extent permitted by law, we are not liable for loss caused by your failure to protect your account or comply with these obligations.
We use your contact details to send messages needed to handle your account, inquiries, quotations, orders, returns and other service matters. Marketing preferences are separate: you can unsubscribe from promotional emails or ask us to stop them. Opting out of marketing does not stop necessary messages about an active inquiry or order.
10. Account Closure and Suspension
You may request account closure by contacting us. Closing an account does not automatically erase all related records: some order, invoice, payment, correspondence and other information may need to be retained for legal obligations, accounting, resolving disputes or handling an existing order. See our Privacy Policy for information about personal data and your rights.
We may suspend or terminate access, with or without notice where appropriate and to the extent permitted by law, if we believe you have breached these terms, supplied false or misleading information, or interfered with another person’s use of the website or services. Existing payment, order and other obligations are not automatically canceled by account closure or suspension.
11. Copyright and Website Content
Website content, including text, graphics, logos, images, video, audio, data compilations and software, belongs to Play With Diamonds, its merchants, content suppliers or software suppliers and is protected by applicable intellectual property laws. The compilation of website content belongs to Play With Diamonds.
You may not copy, transmit, distribute, display, republish, post or upload website content without prior written permission, unless expressly permitted on the website or by law. You may print a copy for personal use, keeping copyright, trademark and other ownership notices intact. Access to the website does not transfer ownership of its content or other intellectual property.
Where we separately authorize the use of product photographs or other materials for your business, that permission is governed by the agreed scope and conditions.
12. Intellectual Property Complaints
We respect the intellectual property of others. If you believe website material infringes your copyright or another intellectual property right, email info@playwithdiamonds.com with:
- Identification of the right or work concerned, including relevant registration numbers or a statement of ownership.
- The exact location of the allegedly infringing material, with sufficient detail for us to find it. A homepage link alone is not sufficient.
- Your name, address, telephone number and email address.
- A statement that you believe in good faith that the disputed use is not authorized by the rights owner, its agent or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are the rights owner or authorized to act on the owner’s behalf.
- An electronic or physical signature of the rights owner or authorized representative.
13. Website Availability and Warranties
Because of the nature of the internet, the website is provided on an “as is” and “as available” basis. We do not promise uninterrupted or entirely error-free access and are not responsible for an inability to provide internet services for reasons beyond our reasonable control.
Except for obligations expressly agreed for your purchase and rights that cannot lawfully be excluded, other warranties, conditions and terms, whether express, implied or statutory, are excluded to the maximum extent permitted by law.
You are responsible for breaches of these terms by you and, to the extent permitted by law, must reimburse us for loss or damage caused by your use of the website in breach of them.
14. Limits of Liability and Events Beyond Our Control
Nothing in these terms excludes or limits rights or liability that cannot be excluded or limited by applicable law, including liability for fraud or fraudulent representation, or death or personal injury resulting from negligence. Any statutory consumer rights that apply remain unaffected.
Subject to those protections, and to the maximum extent permitted by law, Play With Diamonds excludes liability for direct, indirect or consequential loss or damage arising from use of the website, including:
- Incorrect website information.
- Infringement by a person of a third party’s intellectual property rights through use of the website or a purchased product.
- Inability to use the website, or unauthorized access to or alteration of transmissions or data in circumstances beyond our control.
- Loss of profit, wasted expenditure, corruption or destruction of data, or another loss that does not directly result from something we have done wrong.
- Loss or damage caused by viruses or other malicious software affecting equipment, software, data or property through website use, content, emails or attachments.
- Representations, warranties, conditions or other terms that may lawfully be excluded.
We are not liable, to the extent permitted by law, for failure to perform an obligation caused by an unforeseen event beyond our reasonable control, including internet or communications outages, fire, flood, war or other natural disasters. Contact us to discuss the effect of such an event on an existing order.
15. Third-Party Websites and Services
The website may link to, or allow interaction with, third-party websites and services that we do not control or maintain. Links are provided for convenience and do not make us responsible for their content, terms, privacy practices or services.
Third parties may charge fees. Check their terms and investigate any charges before entering into a transaction. Information we provide about third-party charges is for convenience only. Your dealings with third parties are at your own risk, subject to rights that cannot be excluded by law.
16. Indemnification
To the extent permitted by law, you agree to defend and indemnify Play With Diamonds and its directors, employees and agents against third-party claims, demands, losses, damages, fines, penalties and costs, including reasonable legal and accounting fees, arising from:
- Your breach of these terms or documents referenced in them.
- Your violation of a law or a third party’s rights.
- Your purchase of products.
This section is subject to the non-excludable rights and liability protections stated above.
17. Electronic Communications
To the extent permitted by law, we are not responsible for failed, incomplete or corrupted transmissions caused by computer, telephone, cable, network, internet hardware or software failures; service-provider acts or omissions; connection or availability problems; traffic congestion; or unauthorized acts beyond our control. If an expected quotation or confirmation does not arrive, check your spam folder and contact us.
18. Changes to These Terms and Termination
We may change the website and update these terms. Review this page before a new transaction. Changes take effect when published unless a later date is stated, and your continued use of the website after that date constitutes acceptance of the updated website terms.
Updates do not, by themselves, retrospectively change the price, specifications or other terms already agreed for an accepted order. Those changes must be agreed separately or required by law.
We may terminate your access or this website-use agreement, with notice where required by law. Termination does not remove obligations already incurred or rights that remain applicable to an existing order.
19. Personal Data
Our Privacy Policy explains how we handle personal information supplied through the website and related business communications. Our Cookie Policy explains cookies and similar technologies. Do not include unnecessary sensitive personal information in messages or uploaded files.
20. Entire Agreement, Headings and Non-Waiver
These terms and the policies and legal notices referred to in them form the agreement governing your use of the website. For a purchase, the accepted written quotation, order confirmation and any separately agreed project terms also apply. Specific terms expressly agreed in writing for an order take priority over conflicting general website wording for that order, subject to applicable law.
Headings are for convenience and do not define or limit a provision’s meaning. A failure or delay in enforcing a provision does not waive our right to enforce it later or to act in relation to a subsequent breach.
21. Governing Law and Severability
These terms are governed by the laws of Thailand, subject to any mandatory rights or laws that apply to you and cannot lawfully be excluded.
Our performance is subject to applicable laws and legal processes. Nothing in these terms prevents compliance with lawful governmental, law-enforcement or court requirements relating to website use or information supplied to or collected by us.
If a provision is found invalid, illegal or unenforceable, the remaining provisions continue to apply to the extent permitted by law. Rights not expressly granted are reserved.
22. Contact
For questions about these terms, a quotation or an order, email info@playwithdiamonds.com or use our contact page. Include your quotation, order or invoice reference where relevant.
